RTE School Admission 2026: The Delhi High Court has ruled that the Right to Education, RTE, Act does not grant students or parents the right to select a particular school for admission. The observation came while the court was hearing a plea related to admissions under the Economically Weaker Section, EWS, category in Delhi schools. The bench noted that the core objective of the RTE Act is to ensure free and compulsory education for children, especially from disadvantaged backgrounds.

However, it does not extend to guaranteeing admission to a school preferred by the applicant. Admissions under the RTE are conducted through a centralised process, typically involving a lottery system managed by the Directorate of Education, DoE. In this case, the petitioner had sought admission in a specific private school despite being allotted another institution through the official process. The court observed that the allotted school met the eligibility criteria and was within a reasonable distance, but the offer was declined.

The court clarified that the RTE framework is designed to promote equitable access rather than individual choice. Allowing parents to demand specific schools would disrupt the fairness of the allocation system and impact other eligible candidates. The ruling also underlined that admission claims cannot be enforced once the academic session progresses without interim relief.

This decision offers clarity on the limits of the RTE Act in school admissions and reinforces adherence to the structured allocation process followed in Delhi.
