The Delhi government has asked private unaided recognised schools to verify their available vacancies under the economically weaker sections and freeship categories. Schools Must Report Vacancy Data By Tuesday
The Directorate of Education issued an order on August 27, 2026. Under this order all private unaided schools must check their vacancy data. Minority instructions are exempt from this requirement. Other schools must report any discrepancy to their concerned education zone by Thursday. The District Deputy Directors of Education will then examine the representations. They will submit their recommended proposals by September 5, 2026. If a school fails to submit a representation within the given time the vacancy data will be treated as correct. Candidates will then get seats through the computerised draw of lots.
Schools Cannot Refuse Admission to Selected Candidates
The department has made it clear that schools cannot refuse admission to candidates selected through the draw. Schools cannot use the grounds of no vacancy to deny admission. Action will be taken against schools that refuse admission on this ground. This action will follow the Delhi School Education Act and Rules 1973 and the Right of Education Act 2009. The decision comes after an observation by the Delhi High Court. The Case was titled Justice for All versus the Directorate of Education. It concerned the filling of vacant seats under the EWS category from Class 2 onwards.
Under Section 12 of the RTE Act private unaided recognised schools must admit at least 25 percent of students at the entry level from weaker sections and disadvantaged groups. These students get free and compulsory elementary education. The Directorate has been running an online admission process for EWS and freeship seats from Class 2 onwards since the academic session 2021-22. This process applies to private unaided recognised schools running on government allotted land. In 2018 the department decided to fill vacant seats through a computerised draw of lots after inviting online applications. This was on the lines of the process followed for entry level EWS and disadvantaged group admissions.
